Welcome to StarStacker. These Terms & Conditions (“Terms”) govern your use of StarStacker’s services, software, websites, and related offerings (the “Services”). By accessing or using our Services, you agree to comply with these Terms. Please read them carefully.

2. Eligibility

3. Use of Services

  • You may use the Services only for lawful purposes and in accordance with these Terms.

  • You agree not to misuse the Services, including but not limited to spamming, sending unlawful communications, or attempting to interfere with system functionality.

  • You are responsible for ensuring that any messages sent through the Services comply with applicable laws (including SMS/email marketing regulations such as TCPA, CAN-SPAM, and GDPR where applicable).

4. Accounts & Security

  • To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials.

  • You agree to notify us immediately if you suspect unauthorized use of your account.

  • StarStacker is not liable for any loss or damages resulting from unauthorized access to your account.

5. Payments & Billing

  • Services may be billed on a subscription basis through authorized payment processors (e.g., Fanbasis, Stripe).

  • You agree to provide accurate and complete payment information and authorize us to charge applicable fees.

  • All fees are non-refundable unless required by law.

6. Intellectual Property

  • All intellectual property rights in the Services (including logos, designs, software, and content) are owned by Kova Holdings LLC, d/b/a StarStacker.

  • You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

7. Privacy & Data Protection

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your information. By using the Services, you consent to the practices described in our Privacy Policy.

8. Third-Party Services

Our Services may integrate with third-party tools (e.g., Google, OpenPhone, Fanbasis). We are not responsible for the availability, content, or practices of third-party providers.

9. Termination

We may suspend or terminate your account at any time, with or without cause, if you violate these Terms or engage in unlawful or harmful activity. Upon termination, your right to access the Services will immediately cease.

10. Limitation of Liability

  • To the maximum extent permitted by law, StarStacker and Kova Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

  • Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the Services in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless Kova Holdings LLC, d/b/a StarStacker, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the Services or violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Whatcom County, Washington.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
